The Tis Hazari court delivered a significant ruling on Monday, dismissing the bail application of Bibhav Kumar, the former aide of Delhi Chief Minister Arvind Kejriwal, in connection with the Swati Maliwal assault case. Kumar’s arrest stems from allegations related to an assault on Rajya Sabha MP Swati Maliwal.
Scheduled to appear before the court today, Bibhav Kumar faced a decisive moment as Additional Sessions Judge Sushil Anuj Tyagi dismissed his bail plea. The decision followed exhaustive arguments presented by senior advocate N Hariharan for the accused, additional public prosecutor Atul Srivastava, and advocate Madhav Khurana representing Swati Maliwal.
In a courtroom fraught with tension, Maliwal herself stood before the judge, opposing the bail plea and recounting the threats she had received. Emotions ran high as she tearfully expressed her concerns about her safety and that of her family, highlighting the severity of the situation.
The proceedings witnessed a clash of legal arguments, with the defence arguing for bail on grounds of insufficient evidence and procedural irregularities. Senior Advocate Hariharan contended that the charges of Culpable Homicide Not Amounting to Murder lacked substance, emphasising the absence of intent in the alleged offence.
However, the prosecution vehemently opposed the bail application, asserting the seriousness of the charges and pointing to the potential threat posed by release of the accused. Additional Public Prosecutor Atul Srivastava pointed towards the gravity of the situation, highlighting the injuries sustained by Maliwal and the broader implications of the accused’s actions.
Advocate Madhav Khurana, representing Maliwal, echoed her concerns and stressed the need for her voice to be heard in the legal proceedings. Khurana highlighted the alleged threats and intimidation faced by Maliwal, urging the court to consider the broader context of the case.
